Per CSMS 19-000095 UPDATE- Section 301 Increased Duties Postponed

 

As we are all too aware, last fall,[1] President Trump threatened a double hit of tariff increases against certain Chinese origin goods. The initial increase of 10% took effect on September 24, 2018 but the second hit bringing the total increase to 25% was delayed until this Saturday, March 2nd.

As our administration continues to negotiate with Chinese officials, trying to persuade Beijing to make significant structural changes to its economy and business practices, President gave hope of a delay.  On Sunday, Trump tweeted: “As a result of these very productive talks, I will be delaying the U.S. increase in tariffs now scheduled for March 1,” “Assuming both sides make additional progress, we will be planning a Summit for President Xi and myself, at Mar-a-Lago, to conclude an agreement. A very good weekend for U.S. & China!”

Following the President’s lead, the US Trade Representative’s office said on Wednesday that it would move to formally suspend a scheduled tariff increase on Chinese goods “until further notice”.  Although, as yet there has been no such announcement in the Federal Register, and unlike the previous delay in increase, apparently Customs and Border Protection will act upon the President’s instruction and  not enforce the March 2nd enforcement date. Per CSMS 19-000095 UPDATE- Section 301 Increased Duties Postponed:

The rate of additional duties was initially 10 percent.  Those additional duties were effective starting on September 24, 2018, and are currently in effect.  Under Annex B of the September 21 notice, the rate of additional duty was set to increase to 25 percent on January 1, 2019.  On December 19, 2018, USTR published a Federal Register notice changing the effective date of the duty increase to March 2, 2019.  See Federal Register 83 FR 65198, December 19, 2018.On February 24, 2019, the President directed a further delay in the duty increase.

GUIDANCE:
Until further notice, the duty rate for the goods covered by the September 21, 2018 Federal Register notice, as amended, will remain at 10 percent.  The Section 301 duties currently only apply to products of China, and are based on the country of origin, not country of export.

Harmonized System Update (HSU) 1902 was created on February 26, 2019 and contains 40 ABI
records and 11 harmonized tariff records.

This update contains adjustments related to Section 301. Changes were made to extend the 10 percent duty rate on HTS 99038803. This will allow for pre filing of entries at the 10 percent duty rate. Further updates are possible after the forthcoming Federal Register notice is published.

Modifications required by the verification of the 2019 Harmonized Tariff Schedule (HTS) are included as well.

The modified records are currently available to all ABI participants and can be retrieved electronically via the procedures indicated in the CATAIR. Gemini Shippers Group joins Americans for Free Trade coalition in letter to President Trump on tariffs

Gemini Shippers Group ( Fashion Accessories Shippers Association (FASA), Gemini Shippers Association (GSA) and the Fashion Jewelry & Accessories Trade Association (FJATA), as a member of the Americans for Free Trade Coalition joined in sending the following letter to the President today advocating for continues progress in sensible tariff reform.

Dear Mr. President,
On behalf of the Americans for Free Trade coalition, we are writing to commend your
commitment to achieving a fair trade deal with China and for recent progress that has been made
during negotiations. We are encouraged by your decision to avoid a tariff increase on March 2
and allow negotiations to continue ahead of a planned summit with Chinese President Xi Jinping.
We urge you to publish a Federal Register notice immediately confirming and detailing your
decision in order to provide certainty to the business community, making clear to all stakeholders
that tariffs do not automatically increase on March 2. Further, it is our hope that this momentum
will build in the weeks ahead and lead to a final deal that addresses structural issues in China,
removes tariffs on both sides, and eliminates trade uncertainty facing American businesses and
farmers.
Our coalition represents every part of the U.S. economy, including manufacturers,
farmers and agribusinesses, retailers, technology companies, service suppliers, natural gas and
oil companies, importers, exporters, and other supply chain stakeholders. Collectively, we
support tens of millions of American jobs through our vast supply chains. We agree that China
and other trading partners must be held accountable for trade violations. However, broadly
applied tariffs do more harm than good and force American companies to foot the bill for
China’s misbehavior.
According to data released by our coalition, American businesses paid an additional $2.7
billion in tariffs in November 2018 alone, the most recent month data is available from the U.S.
Census Bureau. This represents a $2.7 billion tax increase and a massive year-over-year increase
from $375 million in tariffs on the same products in November 2017. The data also shows that
U.S. export growth hit its lowest level of 2018, thanks in part to a 37 percent decline in exports
of products facing China’s retaliatory tariffs. This data highlights that tariffs as a negotiating
tactic will always be a losing proposition because Americans — not foreign countries — are the
ones paying the price.
Due to these costs, American employers are eager to see trade negotiations conclude as
soon as possible and for all tariffs to be lifted. Although we are encouraged by the latest signs of
progress, it is important to note that existing tariffs and shifting deadlines are hanging over
American businesses and farmers and undermining their ability to grow, invest, and plan for the
future.
Mr. President, we applaud the hard work of your administration to achieve better trade
deals for the American people, and we are encouraged by the progress that has been made. As
negotiations continue, we urge you to continue to listen to the concerns of American businesses
faced with significant uncertainty. We are eager to see a trade deal with China that addresses
structural issues such as intellectual property theft and technology transfer while removing
existing tariffs and the threat of tariffs in the future. Millions of American farmers, businesses,
workers, and families are counting on you to achieve a positive resolution that keeps America
competitive on the global stage while growing our economy and protecting the millions of U.S.
jobs supported by trade.

Tariff Update

Members,
Earlier today President Trump announced that enough progress has been made in the negotiations with the Chinese, so he will be delaying the increase in the List 3 tariffs which was scheduled for March 2.  This announcement did not indicate how long the delay will be in effect for.

As with the delay on January 1, USTR will need to issue a Federal Register notice with the details of the delay so that CBP can program its system so that tariffs don’t automatically increase on March 2.

DTSC Names Methylene Chloride Strippers SCP Priority Product

Amendment to Section 25705 No Significant Risk Level for Bromochloroacetic Acid

February 13, 2019

On February 5, 2019, the Office of Administrative Law approved the amendment of Title 27, California Code of Regulations, section 25705, to add a No Significant Risk Level for the chemical bromochloroacetic acid.  The regulation will be effective on April 1, 2019.  This regulation establishes a No Significant Risk Level of 0.70 micrograms per day for bromochloroacetic acid for purposes of Proposition 65.

European Medical Devices Regulation (MDR) 2017/745 Update: The new European Medical Devices Regulation (MDR) EU 2017/745 will legally apply from May 26, 2020, and SGS, like all other Notified Bodies, will no longer be authorized to deliver CE certificates under the Medical Devices Directive (MDD).

CPSC and FDA Recalls and Consumer Updates;

FTC’s Comment Request: The FTC intends to ask the Office of Management and Budget to extend for an additional three years the current Paperwork Reduction Act clearance for the information collection requirements in the Children’s Online Privacy Protection Act Rule, which will expire on January 31, 2019.

 

F& W’s Comment Request: The agency is seeking feedback on information collected in FWS Forms 3-177 and 3-177a, as well as on related information collected via ACE. Comments, due April 2, should address the necessity of the requirements, their burden on importers and exporters, and ways to improve the information collection.

OFAC’s  Publication of the names of one or more persons and one aircraft that have been placed on OFAC’s Specially Designated Nationals and Blocked Persons List based on OFAC’s determination that one or more applicable legal criteria were satisfied. All property and interests in property subject to U.S. jurisdiction of these persons are blocked, and U.S. persons are generally prohibited from engaging in transactions with them.
